RENTAL AGREEMENT

STALLS

This agreement is for the rental of ______ stall(s). Landlord will assign stall(s) designated for the tenant’s use. “Landlord” includes Wiebe and Amy Dragstra, owners of the property, and any agents representing Wiebe and Amy Dragstra. Rent/Deposit must be paid, and rental agreement (including “Releases From Liability”) signed, prior to occupancy.

The term of this agreement shall begin on _________________, 20____, and shall continue through _________________, 20____, (a period of _____ months and _____ days).

Monthly/Daily rent for each stall is $________. Rent for the first month shall be prorated to the first of the following month, and the rent shall be payable on the first of each month thereafter. Tenant agrees to pay a late charge of 5% of the monthly rent for any month in which payment is not made by the fifth day of that month.

The deposit will be refunded following the termination of the tenancy provided that all terms and conditions of this agreement have been met, and providing that the rented premises are left clean and in acceptable condition. Deductions may be made as appropriate for damage and cleanup.

Tenant will have full responsibility for providing any needed equipment, bedding and feed. Landlord will designate hay and bedding storage areas.

Time and location of available turnout may change according to circumstance and will be assigned by landlord. Individual turnout is not available. Except, stallions that will not be turned out with any other horse.

All manure is to be delivered to designate areas as soon as it is removed from stall. Barn floor is to be swept and kept clean at all times.

NO SMOKING: Smoking is not allowed in any building on the farm. The landlord strongly discourages smoking on any grounds. If smoking does occur, it must be away from any building and matches and cigarette butts must be properly disposed of.

PARKING: Landlord will designate parking areas. These will be the only areas where tenant, will be allowed to park.

RELEASES FROM LIABILITY

Tenant holds harmless and releases from all liability, Blue Valley Farm, Dragstra Stables, Wiebe and Amy Dragstra, landlords, and any of the landlord’s agents, for any occurrence on their property on Blue Valley Road near Southern Pines, North Carolina, for any accident or injury or damage whatsoever. This includes, but is not limited to, any injury in connection with riding or handling any horse, whether mounted or un-mounted, on their property. This includes any ride, which begins or ends on their property. Tenant assumes total responsibility and liability for any animal or person he/she invites onto this property and all of those under his/her supervision on the property, and will reimburse landlord for any damage cased by the same.

Under North Carolina law, an equine activity sponsor or equine professional is not liable for an injury to or death of a participant in equine activities resulting exclusively from the inherent risks of equine activities. Chapter 99E of the North Carolina General Statutes.”
